By ordering a room or vacation home a contract between landlord and guest is closed. The contract must be kept by both parts. If no additional contract agreements were met, the paragraphs of the general civil law book of Austria “Allgemeines Bürgerliches Gesetzbuch Österreich" are decisive.

Accommodation Agreement

The Accommodation Agreement shall be deemed entered into upon the acceptance of the Party’s order by the Proprietor (in writing or verbally). Rights and duties cannot be assigned to a third party without agreement. By entering into an Accommodation Agreement, the Party shall acquire the right to make normal use of the rented rooms and the facilities of the accommodating establishment that are usually accessible to the guests for use without any special conditions and of the usual service. The Party shall be obliged to accept the booked room in time and pay the agreed remuneration plus any extra amounts that have arisen from the use of special services by the Party and/or the accompanying guests plus any applicable VAT by the date of departure at the latest. The Accommodation Agreement contains in principle also the delivery of the breakfast, except with vacation homes.

Cancellation
If one of the two partners breaks the Accommodation Agreement, then it is obligated to substitution of the developed damage. For it the reservation conditions of each individual landlord are decisive.

Down payment

The Proprietor shall be entitled to enter into the Accommodation Agreement under the condition that the Party makes a down payment (or even the agreed remuneration).

I. Area of Application, Conclusion of Contract

Kleinwalsertal Tourismus (KT) enters into a business relationship with a booker as an intermediary. A contract is thus concluded between the booker and the accommodation provider. This contract is subject to the following General Terms and Conditions of Business in the version prevailing at the time of booking. Any reciprocal claims deriving from this contract are only to be asserted against the immediate contractual partner and without any liability on the part of Kleinwalsertal Tourismus. Kleinwalsertal Tourismus agrees with the booker that the "GENERAL TERMS AND CONDITIONS FOR THE HOTEL INDUSTRY 2006" (AGBH 2006) as of 15 November 2006 as well as the supplemental General Terms and Conditions of Business mentioned here have legal force for the accommodation contract as well as for the mediation of the same.

II. Special emphasis is placed on the section "Rescission by the Party – Cancellation fee" and reproduced in excerpt form here:

5.5 The Party may rescind the Accommodation Agreement by means of a unilateral declaration by 3 months before the agreed date of arrival of the Guest without being liable to pay a cancellation fee.
5.6 Outside the period specified in § 5.5., the Party may only rescind the Accommodation Agreement by means of a unilateral declaration subject to the following cancellation fees:
- 40% of the total agreed price by 1 month before the date of arrival
- 70% of the total agreed price by 1 week before the date of arrival
- 90% of the total agreed price within the last week preceding the date of arrival

The mediation fee of Kleinwalsertal Tourismus in the original amount remains unchanged, however.
In the event of a cancellation within one month, the cancellation invoice is sent to the booker only following the original dates of stay.

Kleinwalsertal Tourismus will offer a voyage cancellation insurance for every booking the booker makes. The premium is charged to the booker.

III. Supplemental General Terms and Conditions of Business:

The contractual partner agree on Austrian Law for the accommodation contract as well as the mediation contract.
No additional agreements are made.
Alterations and supplements to this contract must be made in writing to be legally effective.
It is agreed that the Regional Court of Bezau has legal jurisdiction in any disputes arising out of this legal transaction - also those concerning the existence of the legal transaction.
Place of performance is Kleinwalsertal.
The accommodation provider expressly confirms that the Austrian Hotel Contractual Conditions have legal validity for all mediations, and, additionally, the accommodation provider declares to know, have received and to accept in full the General Terms and Conditions of Business for every mediation.
Kleinwalsertal Tourismus applies the prevailing data protection acts when processing person and company related details. The data received is solely collected, processed and utilised insofar as it is required for the justification, form or alteration of its own as well as, if need, be mediated business relationships. Kleinwalsertal Tourismus is entitled to pass on this data to partners commissioned by Kleinwalsertal Tourismus insofar it is necessary to process reservation queries or bookings. If the guest expressly agrees his/her consent, Kleinwalsertal Tourismus is furthermore entitled to record, process and use the data received from the guest for the purposes of advising, advertising, market research as well as to devise offers.
No guarantee can be given for the content and the correctness of the picture material provided by the accommodation provider.
When paying the required down payment the booker issues his irrevocable consent to cashless debiting via the respective bank. It is pointed out that the credit card institute of Kleinwalsertal Tourismus is possibly not identical with the credit card institute of the accommodation provider.
